1. Acceptance of terms
Descriptions, images, references, features, content, specifications, products, price and availability of any products or services are subject to change without notice, and our current prices can be found on our Site. We make reasonable efforts to accurately display the attributes of our products, including the applicable colors; however, the actual color you see will depend upon the color deliverance of our printing agency, and we cannot guarantee that colors will print exactly as viewed. However, we will only deliver and produce satisfactory products. The inclusion of any products or services on our Site at a particular time does not imply or warrant that these products or services will be available at any time. It is your responsibility to ascertain and obey all applicable local, state, federal and international laws (including minimum age requirements) in regard to the possession, use and sale of any item purchased through our Site. By placing an order, you represent that the products ordered will be used only in a lawful manner. We reserve the right, with or without prior notice, to limit the available quantity of or discontinue any product or service; to honor, or impose conditions on the honoring of, any coupon, coupon code, promotional code or other similar promotions; to bar any user from making any or all purchase(s); and/or to refuse to provide any user with any product or service.
2. Photo Specifications
We will use any image you provided to us. However, we don't recommend using images created for or taken from the Internet. They typically will result in poor print quality.
A. Image Quality
The quality of your printed card is tied to the quality of the photo you give us. For the best possible results, you should make sure to start with a clear, shadow-free, high-resolution image. It's really important for you to preview your image carefully before you order. We don't proof your images or products ordered before printing, so you will be liable for any misprint as a result.
Tips for choosing high-quality photos:
*Check the Image Resolution: This is basically just the number of pixels in your image file. Low-resolution images will look blurry or pixilated when printed. It's always smart to use high-resolution images to get the best results.
*Review the Subjective Quality of the Image: This isn't something that any computer can measure - it's up to you to pick the "clearest" picture possible. For example, photos that are out of focus, over exposed, poorly composed, too dark, or have too much contrast, are not going to look good when they're printed. This is true even of photos that have a high resolution. If you're not sure, it's better safe than sorry.
3. Out of State Orders
In an effort to continue to provide quality low price products, customers located outside of Nashville, TN assemblage will not apply to chocolate bars, water bottles, and wine bottles. We will provide you with the necessary content and/instructions on how to's. We will only ship the custom labels.
4. Permission to use Product for Promotional Purposes
You authorize Kidz Zone Party Castle, hereafter referred to as "Kidz Zone," to publish photographs and/or relevant information pertaining to the creation of its products of myself and/or the minor child or children for use in the Kidz Zone's print, online and video-based marketing materials, as well as other Company publications. You hereby release and hold harmless Kidz Zone from any reasonable expectation of privacy or confidentiality for myself and for the minor child and children listed below associated with the images and other relevant information specified above. You further attest that you are the parent or legal guardian of the child or children listed below and that you have full authority to consent and authorize Kidz Zone to use their likenesses and names.
You further acknowledge that participation is voluntary and the minor child, or minor children will receive financial compensation of any type associated with the publication this information in company marketing materials or other Company publications. You acknowledge and agree that publication of said photos confers no rights of ownership or royalties whatsoever. You hereby release Kidz Zone its contractors, its employees and any third parties involved in the creation or publication of Company publications, from liability for any claims by me or any third party in connection with my participation or the participation of the minor children listed below.
5. COPYRIGHT ISSUES
While we are not obligated to review User Submitted Materials for copyright infringement, we are committed to protecting copyrights and expect users of our Site to do the same. The Digital Millennium Copyright Act of 1998 (the "DMCA") provides recourse for copyright owners who believe that material appearing on the Internet infringes their rights under U.S. copyright law. If you believe in good faith that any material used or displayed on or through our Site infringes your copyright, you (or your agent) may send us a notice requesting that the material be removed, or access to it blocked. The notice must include the following information: (a) a physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed; (b) identification of the copyrighted work claimed to have been infringed (or if multiple copyrighted works are covered by a single notification, a representative list of such works); (c) identification of the material that is claimed to be infringing or the subject of infringing activity, and information reasonably sufficient to allow us to locate the material on our Sites and Apps; (d) the name, address, telephone number and email address (if available) of the complaining party; (e) a statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent or the law; and (f) a statement that the information in the notification is accurate and, under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
